General terms and conditions (GTC) for www.madamefleurs.com
For the business relationship between Madame Fleurs (hereinafter vendor / seller) and the customer (hereinafter "customer"), the following general terms and conditions apply exclusively in the version valid at the time of the order. Deviating conditions of the customer will not be recognized unless the seller expressly agrees to their validity. A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for a purpose that can predominantly neither be attributed to their commercial nor their independent professional activity (§ 13 BGB). The terms and conditions also apply if the offer is accessed from outside the Federal Republic of Germany.
2. Conclusion of the contract
Despite taking the greatest possible care, Madame Fleurs expressly reserves the right to make any printing errors, mistakes or changes in color to the products shown in the online shop. The presentation and promotion of articles in the online shop of Madame Fleurs does not constitute a binding offer to conclude a purchase contract. By submitting an order via the online shop by clicking the "Pay" button on PayPal, the customer is placing a legally binding order for im Goods contained in the shopping cart. The confirmation of the receipt of the customer's order takes place together with the acceptance of the order immediately after it has been sent by automated e-mail. If delivery of the goods ordered by the customer is not possible, for example because the goods in question are not in stock or will not be available in the foreseeable future, both parties have the right to withdraw from the purchase contract. In these cases, Madame Fleurs will inform the customer immediately and refund any payments already received.
3. Prices and shipping costs
All prices stated on Madame Fleurs' website include the applicable statutory sales tax. Shipping within the Federal Republic of Germany costs a flat rate of 4.90 euros and is free for purchases of 70 euros or more. If the customer makes use of an existing right of withdrawal, he has to bear the regular costs of the return.
4. Delivery & availability of goods
DUE TO HIGH DEMAND, THE PROCESSING TIME IS CURRENTLY 3-5 WORKING DAYS. (Status February 2021). The availability of goods is indicated on the respective product detail page. Unless otherwise stated, the delivery time is 4 - 7 working days (2-4 working days preparation time and 2-3 working days shipping). If an article is permanently unavailable, Madame Fleurs will inform the customer, and a contract will not be concluded in this case. In such a case, Madame Fleurs will immediately reimburse any payments already made by the customer. If not all of the products ordered are in stock, Madame Fleurs is entitled to make partial deliveries at her own expense, provided this is reasonable for the customer.
5. Payment terms
Payment is made via PayPal or credit card.
6. Material defect warranty & guarantee
The guarantee is based on statutory provisions. The goods delivered by the seller are only guaranteed if this has been expressly given.
The following exclusions and limitations of liability apply to the seller's liability for damages, regardless of the other statutory entitlement requirements. The seller has unlimited liability insofar as the cause of the damage is based on intent or gross negligence. Furthermore, the seller is liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the customer regularly relies.
In this case, however, the seller is only liable for the foreseeable, contract-typical damage. The seller is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences. The above limitations of liability do not apply in the event of injury to life, body or health, for a defect after assuming a guarantee for the quality of the product and for maliciously concealed defects . Liability under the Product Liability Act remains unaffected. Insofar as the seller's liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

1. Right of return and cancellation policy
If you are not satisfied with your product, you can of course send it back and we will reimburse you for the product costs (excluding shipping costs). The return period is 14 days after receipt of the goods. Please note, however, that we can only refund products that are unopened and unused.

4. The products are damaged, what can I do?
In some cases it can happen that, despite the careful preparation of the package, mishaps occur and this can also lead to damage to the package and the products. 5. How do returns work?
To return your order to us, please contact us by email at email@example.com.
After we have received your message, we will give you all the instructions to proceed with your return and you will get the return address from us.
Please note that we do not cover the cost of the return shipping and can only refund the cost of the product (excluding the original shipping costs).

5. When will I get my refund?
Your refund will be released once the return has been processed. The amount will be returned to the account or card that was used for the purchase.
